Refund Policy

Cancellation Policy I. Cancellation, Security Deposit and Refund Policies 1. All requests to cancel a booking must be submitted in writing via email to the apartment. For further details regarding security deposits and refund policies, please refer to Part II of these Booking Terms and Conditions. 2. Unless otherwise stated, all rooms/beds and rent are intended for single occupancy only, and the final rent and charges shall be as stipulated in your Residential Lease Agreement. 3. If you wish to arrive at the apartment earlier than your booked initial check-in date, please contact the apartment using the contact details provided in Section I, Clause 2; additional fees may apply. II. Identity Verification Requirements 1. You must provide the following to the apartment upon or prior to checking into your room/bed: (i) Proof of enrolment at an Australian educational institution; (ii) A valid and current form of identification, including a passport with visa, driver's licence, or other government-issued photo ID; (iii) Any background check (including employment and/or tenancy checks) required by the apartment. 2. If you fail to provide the documentation specified in Section I, Clause 5(a), the apartment reserves the right, at its sole discretion, to: (i) Cancel your booking, and retain any security deposit and/or other payments made by you, to the extent permitted under applicable state law; (ii) Delay the effective date of the Residential Lease Agreement until you provide the required documentation. 3. By booking with the apartment, you confirm that you have been accepted, or have applied and expect to be accepted, into a study program at an Australian school, college, university, or similar educational institution for the duration of the Residential Lease Agreement. III. Age Requirements 1. Except as otherwise provided in Section I, Clauses 6(b) and (c), by booking with the apartment, you confirm that you are at least 18 years of age. 2. If you are under 18 at the time of booking: (i) Parental or guardian consent is required to make the booking; (ii) By making the booking, you confirm that your parent or guardian consents to the booking. 3. If you are under 18 at the time the Residential Lease Agreement becomes effective, you may require approval from your educational institution to reside at the apartment, and your parent or guardian may need to co-sign and/or guarantee your Residential Lease Agreement. 4. If you book any property owned or managed by the apartment, you must be at least 16 years of age when the Residential Lease Agreement becomes effective. The apartment does not accept bookings from, nor enter into Residential Lease Agreements with, individuals under the age of 16. IV. Lease Agreement and Security Deposit 1. Prior to check-in, carefully review the proposed lease agreement terms. Proceeding with the booking constitutes your acknowledgment that you have read and understood those terms. 2. Pursuant to the lease agreement terms (without limiting such terms), you acknowledge that subletting of the room/bed is prohibited and pets are not permitted on the premises. 3. Prior to the apartment permitting you to occupy the room/bed, you must, in addition to other requirements set by the apartment, pay the security deposit and provide a signed lease agreement. 4. If you fail to provide any item required for check-in (including but not limited to the security deposit, signed lease agreement, first rental payment, or background check materials) within the timeframe specified by the apartment, the apartment reserves the right, at its sole discretion, to: (i) Cancel your booking, and retain any security deposit and/or other payments made by you, to the extent permitted under applicable state law; (ii) Delay the effective date of the Residential Lease Agreement until you provide the required items. 5. In case of inconsistency: (i) Where these Booking Terms and Conditions conflict with the terms of your Residential Lease Agreement, the Residential Lease Agreement terms prevail; (ii) Where Part I and Part II of these Booking Terms and Conditions conflict, Part II prevails. V. Payment Methods 1. To book an apartment, you must be able to pay rent via one of the following methods: (i) Direct debit every two weeks, requiring Australian bank account details or payment via Mastercard or Visa; (ii) Full prepayment via bank transfer (to the apartment’s designated account) or credit card; (iii) Other methods determined at the apartment’s sole discretion, or as required by applicable state law. 2. Additional fees may apply for payments made by credit card, Mastercard or Visa, and must be paid at the time of booking. VI. Privacy Policy 1. When booking with the apartment, you may be required to provide personal information. The apartment may also collect your personal information (e.g., age, gender, nationality, disability status) to allocate an appropriate room/bed for you. 2. Please refer to the apartment’s Privacy Policy, which outlines the terms governing the collection, storage, use, disclosure and handling of personal information. 3. By booking with the apartment, you: (i) Confirm that you have read and understood the apartment’s Privacy Policy; (ii) Consent to the apartment collecting, storing, using, disclosing and handling your personal information in accordance with the Privacy Policy; (iii) Warrant that all personal information you provide is accurate. Part II – Cancellation and Refund Policy 1. Important Notice: The information set out in Part II of these Booking Terms and Conditions relates to cancellations prior to signing and/or commencement of the Residential Lease Agreement. Cancellations after signing and/or commencement of the Residential Lease Agreement are governed by separate provisions. 2. Refund Process: (i) Notwithstanding any other provision herein, to arrange a refund of any amount you have paid (including the security deposit), you must first complete and submit the Refund Form to the apartment. A copy of the Refund Form is included in Part III of these Booking Terms and Conditions (subject to periodic updates). (ii) All refunds will be processed via bank transfer (or another method selected by the apartment), and completed within the timeframe prescribed by applicable state law; if no timeframe is prescribed, refunds will be processed within a reasonable time after receipt of a properly completed Refund Form. 3. Apartments located in New South Wales, Australia: (i) To book a room/bed at an apartment located in New South Wales, Australia, you must pay a security deposit equivalent to one week’s rent at the time of booking. (ii) Upon payment of the security deposit, you will be granted a “cooling-off period”, which ends at the earlier of: - The effective date of the Residential Lease Agreement; - 48 hours after payment of the security deposit (“cooling-off period”). (iii) During the cooling-off period, you may cancel your booking by written notice to the apartment, in which case your booking will be cancelled and your security deposit fully refunded. To obtain a refund as required under applicable state law, please complete and submit the Refund Form. (iv) You must sign the Residential Lease Agreement prior to arriving at the apartment, at which point the security deposit will be applied toward the first rental payment due under the Residential Lease Agreement. (v) If you request cancellation of your booking, or fail to sign the Residential Lease Agreement within the timeframe specified by the apartment, your booking may be cancelled and all payments made (if any) will be refunded to you, less the security deposit. 4. Apartments located in Queensland, Australia: (i) To book a room/bed at an apartment located in Queensland, Australia, you must pay a security deposit equivalent to one week’s rent at the time of booking. (ii) Upon payment of the security deposit, you will be granted a “cooling-off period”, which ends at the earlier of: - The effective date of the Residential Lease Agreement; - 48 hours after payment of the security deposit (“cooling-off period”). (iii) During the cooling-off period, you may cancel your booking by written notice to the apartment, in which case your booking will be cancelled and your security deposit fully refunded. To obtain a refund as required under applicable state law, please complete and submit the Refund Form. (iv) You must sign the Residential Lease Agreement within the timeframe specified by the apartment following payment of the security deposit, at which point the security deposit becomes part of the lease security bond. (v) If you: - Fail to notify the apartment in writing requesting cancellation during the cooling-off period, or request cancellation after the cooling-off period; or - Fail to execute the Residential Lease Agreement within the timeframe required under Part II, Clause 4(d), the apartment may cancel your booking and refund all payments made, less the security deposit. 5. Apartments located in Victoria, Australia: (i) To book a room/bed at an apartment located in Victoria, Australia, you must pay a security deposit equivalent to one week’s rent at the time of booking. (ii) Upon payment of the security deposit, you will be granted a “cooling-off period”, which ends at the earlier of: - The effective date of the Residential Lease Agreement; - 48 hours after payment of the security deposit (“cooling-off period”). (iii) During the cooling-off period, you may cancel your booking by written notice to the apartment, in which case your booking will be cancelled and your security deposit fully refunded. To obtain a refund as required under applicable state law, please complete and submit the Refund Form. (iv) You must sign the lease agreement within 14 days after payment of the security deposit. (v) To obtain a refund of the security deposit as required under applicable state law, please complete and submit the Refund Form. 6. Apartments located in South Australia, Australia: (i) To book a room at an apartment located in South Australia, Australia, you must pay a security deposit equivalent to one week’s rent at the time of booking. (ii) Upon payment of the security deposit, you will be granted a “cooling-off period”, which ends at the earlier of: - The effective date of the Residential Lease Agreement; - 48 hours after payment of the security deposit (“cooling-off period”). (iii) During the cooling-off period, you may cancel your booking by written notice to the apartment, in which case your booking will be cancelled and your security deposit fully refunded. To obtain a refund as required under applicable state law, please complete and submit the Refund Form. (iv) You must sign the Residential Lease Agreement prior to arriving at the apartment, at which point the security deposit will be applied toward the first rental payment due under the Residential Lease Agreement. (v) If you request cancellation of your booking, or fail to sign the Residential Lease Agreement within the timeframe specified by the apartment, your booking may be cancelled and all payments made (if any) will be refunded to you, less the security deposit. 7. Exceptional Circumstances: (i) The apartment acknowledges that some applicants seek accommodation while awaiting confirmation of acceptance and/or offer of admission from an educational institution and subsequent course enrolment, or an Australian student visa issued by the Australian Government. (ii) Notwithstanding any other provision herein, if you have paid a security deposit to the apartment and: - Your application for an Australian student visa has been refused by the Australian Government, or the visa has not been issued to you; and/or - You have not been accepted by any educational institution to which you applied, you may request cancellation in writing, in which case: - Your booking will be cancelled; - Your security deposit and all payments made will be fully refunded (“full refund”). (iii) To qualify for a full refund, you must provide the apartment with: - Written evidence of the circumstances described in Part II, Clause 7(b); - Written notice delivered at least three days prior to the effective date of the lease agreement; - A properly completed Refund Form. (iv) If you fail to comply with the requirements set out in Part II, Clause 7(c), you will not be eligible for a full refund, and Part II, Clause 7 shall not apply. 8. Apartment Cancellation: At any time prior to the signing and/or commencement of the Residential Lease Agreement, the apartment may, at its sole discretion (but subject to applicable state law), cancel your booking if any of the following occurs: (i) Information provided by you during the booking process is false or misleading; (ii) You have failed to comply with your obligations under these Booking Terms and Conditions. In such cases, to the extent permitted under applicable state law, the apartment may retain any security deposit and/or other payments made by you. This policy applies only to individual bookings; group bookings are not subject to the same terms and conditions.
